Stone company sues construction company, alleging nonpayment

An Aurora business filed suit against a Virginia construction company for alleged breach of contract in a 2014 dispute.

Classic Stone LLC (Chicago Metal) filed a complaint April 28 in Cook County Circuit Court, claiming liability in a December 2014 disagreement with Fred Williams Construction Co. (Frebet Inc.), headquartered in Richmond, Va., and doing business in Cook County.

The plaintiff, located at 636 Plum St., Aurora, sells and installs natural stone products for businesses and industries. The lawsuit states that the parties entered an agreement on or about Dec. 12, 2014. In addition to the contract, the defendant allegedly requested expedited shipping.

According to the complaint, the total cost of product and labor supplied to the Williams company was at least $75,236. Classic Stone contends the defendant has remitted only $25,000 to date. The filing notes the defendant's contractor complained directly to the plaintiff regarding services.

Alleging breach of contract, Classic Stone seeks actual, monetary and punitive damages in the amount of at least $46,206, plus attorneys’ fees, expenses and costs. They are represented in the case by attorney Thomas Paris, of Chicago.
