A Kansas insurance company filed a lawsuit against a Cook County health care business for alleged breach of contract in a 2013 matter.
AmTrust Insurance Co. of Kansas Inc. filed a complaint April 28 in Cook County Circuit Court against Medical Professionals for Home Health Care Inc., claiming liability in an April 2013 occurrence.
The plaintiff provided Workers Compensation Insurance to the defendant for the period covering April 13, 2012, through April 13, 2013. The lawsuit states that AmTrust provided the coverage in compliance with the policy terms.
According to the filing, the defendant renewed its policy for the following two consecutive years through April 13, 2015.
When the plaintiff audited the defendant’s books and records after April 13, 2013, to assess the true extent of liability risks, it claimed that the defendant owed it a net sum for each coverage period, and asserts the defendant failed to pay despite requests.
The policy was cancelled prorata for non-payment on April 28, 2014. Citing three separate counts of breach of contract, AmTrust Insurance Co. seeks total damages of $69,037, plus pre-judgment interest, attorneys’ fees and costs.
