A railroad worker has sued his employers, alleging liability in a 2013 accident at a rail yard.
Michael Kremidas, of Palos Hills, filed suit April 28 in Cook County Circuit Court against Canadian Pacific Railway and Soo Line Railroad Company, alleging negligence in a 2013 work-related injury.
According to the complaint, Kremidas has worked for the defendant since 2009, performing his work duties in the premises known as F Yard, with locales in Bensenville, and elsewhere in Cook and DuPage counties. The suit says the plaintiff was injured June 8, 2013, while stepping out of a train car onto rock ballast when the ballast shifted under his foot.
The suit alleges the defendants failed to furnish safe ground to work on; use smaller sized rock ballast in the yard despite supposedly known difficulties navigating the existing large size; replace or repair the ballast; and correct other alleged flaws relating to the ground surface.
The plaintiff cites pain and injuries, disability, disfigurement, loss of a normal life, medical bills and lost earning capacity.
Kermidas seeks damages of more than $50,000, plus attorney fees and costs. He is represented by attorney Daniel Seidman, of Seidman Margulis & Fairman in Chicago.
