A bus passenger has sued the Chicago Transit Authority and a motorist, alleging liability for injuries he suffered in a 2014 accident.
Jesse Gaither filed suit May 4 in Cook County Circuit Court against the CTA and motorist Sylvester Bolds over a November 2014 accident.
According to the complaint, on Nov. 7, 2014, Gaither was a passenger on a CTA bus as it was traveling westbound on Madison Avenue in Chicago and collided with the rear of a vehicle, driven by Bolds.
The plaintiff cites the CTA for improperly operating, managing, maintaining and controlling the bus to avoid injuring him; operating the bus without a sufficient lookout for other vehicles; driving at a greater speed than was reasonable for the circumstances; failing to reduce its speed to avoid collision; following Bolds’ vehicle too closely; and failing to give Bolds audible warning, slow down or stop to avoid the impact.
Additionally, Gaither alleges Bolds drove improperly and stopped suddenly without warning or regard for traffic conditions.
The plaintiff cites personal, permanent and pecuniary damages.
Gaither seeks damages of more than$30,000, plus attorney fees and costs. He is represented by attorney Michael Hume, of Cary Wintroub & Associates in Chicago.
