Cyclist sues driver for injuries from collision at Western Avenue, Kennedy Expressway

A bicyclist filed suit against a driver for alleged vehicular negligence in a 2013 accident.

David Finley filed suit May 11 in Cook County Circuit Court against Peggy Bang claiming she is liable for his injuries in an August 2013 incident.

The suit said Finley was operating a bicycle southbound on Western Avenue near the street's intersection with the Kennedy Expressway in Chicago on Aug. 24, 2013. The suit claims Bang struck the plaintiff’s bicycle while she was driving a motor vehicle northbound on the off ramp from the Kennedy Expressway at Western Avenue.

The suit alleges Bang was driving at an excessive speed for the circumstances and operating her vehicle without adequate brakes. The suit also cites failure to see and observe the bicycle; decrease her speed and stop her car to avoid cutting off the cyclist; and failure to yield the right of way to the plaintiff.

The suit cites severe injuries, prevention from attending to everyday duties, pain and anguish, and medical expenses. The suit seeks compensation of more than $50,000, plus attorneys’ fees and costs. Finley is represented in the case by Mark Murnane, of O’Connor & Nakos in Chicago.
