A woman filed a complaint against a Cook County driver for allegedly hitting her with his car while she was crossing Jackson Boulevard in Chicago in 2013.
Stacie Freil filed a lawsuit May 19 in Cook County Circuit Court against Mario Xavier, of Chicago, claiming vehicular negligence in an August 2013 injury.
According to the filing, Freil was walking north on Des Plaines Street in Chicago at about 10 p.m. on Aug. 25, 2013, at its intersection with Jackson Boulevard.
The lawsuit states Xavier was operating a motor vehicle facing south on Des Plaines at the Jackson Boulevard junction; and allegedly attempted to turn left against the light as Freil was crossing the intersection. Court documents indicate Xavier’s vehicle struck the plaintiff, causing injuries.
The defendant is cited with failing to maintain a proper lookout; control the vehicle; yield the right of way; brake or swerve to avoid or diminish impact; and sound his horn. He also is cited with driving recklessly at an excessive speed, failing to exercise due care and obey traffic laws.
The plaintiff was transported by ambulance to a hospital and treated for bruises, cuts and nerve damage requiring surgery, according to the filing. The lawsuit contends Freil suffered substantial pecuniary and personal loss, including pain and suffering, disability and disfigurement, lost wages and medical expenses.
The plaintiff seeks compensation of more than $50,000, plus attorneys’ fees and costs. She is represented in the case by Michael Bonamarte IV, of Levin and Perconti in Chicago.
