A woman has sued a driver she blames for striking her with his car while she was in a crosswalk in a 2013 incident.
Mollie Ragland filed suit May 15 in Cook County Circuit Court against Francisco Perez, of Chicago, claiming vehicular negligence in a December 2013 injury.
The suit said Perez was driving a vehicle he owned northbound from Aberdeen Street near 1059 W. Jackson Boulevard onto Jackson Boulevard in Chicago on Dec. 18, 2013. The suit said Ragland was crossing on foot within the crosswalk northbound on Jackson Boulevard and was injured when Perez’s vehicle struck her.
The suit said Perez was acting within his scope as the vehicle’s owner. The suit alleges Perez failed to see the plaintiff; reduce speed or swerve to avoid collision; sound his horn or otherwise give audible warning; control his vehicle; and yield the right of way to a pedestrian in a crosswalk.
The suit contends Ragland suffered severe and permanent injuries, pain, loss of a normal life, diminished ability to tend to her usual affairs, loss of earning capacity, and medical expenses. The suit seeks compensation of more than $50,000, plus attorneys’ fees and costs. She is represented in the case by attorney M. Andrew Hamilton, of Chicago.
