Mother, daughter bring driver to court alleging crosswalk pedestrian collision

A Cook County mother filed suit on behalf of herself and her daughter against a motorist, claiming vehicular negligence in a 2013 pedestrian accident at a Chicago intersection.

Catrena Yarbrough, individually and as next friend of minor Peyonce Price, brought a complaint against Martin William of Chicago in Cook County Circuit Court on June 29, alleging negligence in a July 2013 collision.

According to the filing, Peyonce Price was crossing Marquette Road on foot in a crosswalk near Michigan Avenue in Chicago on July 11, 2013, when William, operating a motor vehicle westbound on Marquette, struck the girl.

The suit states that the defendant violated traffic laws and was negligent by failing to keep a sufficient lookout for pedestrians, decrease his speed, yield the right of way to avoid an accident, maintain proper brakes, sound his horn, slow down and stop to avoid danger, and control his vehicle.

The plaintiffs maintain that the girl sustained personal injuries, medical and hospital expenses, and temporary limitation of daily activities.

The plaintiffs seek damages in excess of $50,000 plus attorney’s fees and costs. They are represented in the case by Harvey L. Walner & Associates in Chicago.
