Man sues Metra, Union Pacific for wrongful death of wife

A Cook County man is suing Metra and Union Pacific for the wrongful death of his wife, who died after she was struck by a commuter train.

Leo C. Thier, as special administrator of the estate of Amy C. Their, filed a lawsuit July 31 in Cook County Circuit Court against the Northeast Illinois Regional Corp. and the Commuter Rail Division of the Regional Transportation Authority, both doing business as Metra, and against Union Pacific Railroad, citing negligence.

According to the claim, the defendants practiced careless judgment while operating a commuter train on July 31, 2014, while traveling near the Cumberland station, 485 Northwest Highway, Des Plaines, when it struck Thier while she crossed the tracks. The accident caused her to suffer irrevocable and fatal injuries, the complaint states.

Leo C. Thier, as special administrator and spouse, is seeking damages in excess of the jurisdictional limit, plus the costs of this lawsuit. He is being represented by Marc E. McCallister of Gary D. McCallister and Associates, LLC in Chicago.
