Bicyclist alleges negligence after accident with cab door

A bicyclist is suing a  cab driver and the cab company, alleging she was struck by one of the cab's doors in a bike lane.

Sarah Pelsoh filed a complaint Aug. 3 in Cook County Circuit Court against Bashir S. Mohamed, Joseph M. Hoffman and Lucky Seven Chicago Inc., alleging carelessness and negligence.

According to the complaint, on Aug. 28, 2013, Pelsoh was riding her bicycle west near 1034 W. Chicago Ave. The suit says Mohamed was driving a cab owned by the other defendants driving west on the same road when he stopped and allowed a passenger to open a door, which struck Pelsoh's bicycle.

The suit says the defendants operated or owned a vehicle that caused another injury, allowed a passenger to open their door in traffic, endangered the bicyclist, and failed to exercise due care, discharge his passenger at the curb and stay out of the bicycle lane.

The plaintiff alleges injuries, pain and suffering, and medical expenses.

Pelsoh seeks damages of more than $150,000, plus costs. She is represented by attorneys James Freeman and Brendan Kevenides of the Freeman, Kevenides Law Firm in Chicago.
