A patient is suing a doctor and his practice, alleging a botched knee implant surgery.
James Weidenhagen filed a lawsuit Aug. 7 in Cook County Circuit Court against Orthopaedic Specialists of the North Shore and Dr. Ronald Silver, alleging medical negligence.
According to the complaint, on Aug. 7, 2012, Silver diagnosed Weidenhagen with osteoarthritis of the right knee and on Jan. 14, 2013, the plaintiff was admitted to St. Francis Hospital for Silver to perform a right total knee arthroplasty, during which time he implanted a "Stryker triathlon posterior cruciate retaining prosthesis."
According to the lawsuit, the defendants were negligent by failing to diagnose the plaintiff's posterior cruciate ligament, evaluate the condition of the ligament, avoid injuring the ligament during the arthroplasty, and use another implant when the plaintiff didn't have an intact ligament.
As a result, the plaintiff has suffered injury, pain and suffering, disability, and medical expenses, the suit states.
Weidenhagen seeks damages of more than $50,000, plus costs. He is represented by attorney James P. Tutaj of FreemanTutaj in Grayslake.
