Family alleges negligence in man's pre-death pressure sores

Ulcers

A man's family is suing a nursing home, alleging negligence in the pressure sores he developed just prior to death.

Latoya Stubbs, as executor of the estate of Ozzie Longino, filed a lawsuit Aug. 4 in Cook County Circuit Court against Lexington Health Care Center of Chicago Ridge Inc., doing business as Lexington of Chicago Ridge, Dr. Virendra D. Mathur, and Midway Internal Medicine.

According to the complaint, on Aug. 18, 2013, Longino was admitted to Lexington and during that time, he developed sacral pressure ulcers that intensified until his death Sept. 19, 2013.

The suit says the defendants violated the state Nursing Home Care Act, specifically failing to provide adequate care, assistance turning in bed, and treatment to prevent the worsening of the sores.

Stubbs seeks damages of more than $300,000, plus costs. She is represented by Nemeroff Law Offices in Chicago.

Cook County Circuit Court case number 2015L007946.
