A couple is suing over claims of the Family Expense Act against a certain physician and an Illinois-based health care center.

Tracey and Michael Van Kley, as parents and next friends of minor Nicholas Van Kley, filed a lawsuit in Cook County Circuit Court, Law Division on Aug. 11 against Dr. Thom E. Lobe and Advocate Health and Hospitals Corp., doing business as Advocate Medical Group, and Advocate Christ Hospital and Medical Center, citing the Family Expense Act.

According to the claim, Nicholas Van Kley underwent a  laparoscopic splenectomy surgical procedure while in the care of Dr. Lobe and the aforementioned health care organization on Aug. 1, 2012, when during the procedure an endobag containing his spleen ruptured, causing injury to him. Further surgeries on June 25, 2014, and April 9 found numerous implants of splenic tissue in Nicholas Van Kley's abdomen that were left by the defendants, according to the claim.

Tracey and Michael Van Kley are seeking damages of more than $50,000 and compensation for the medical, surgical, hospital and other expenses incurred to treat Nicholas Van Kley for his healing process, the claim states.

They are being represented by Lawrence R. Kream of the the Law Office of Lawrence R. Kream LLC in Chicago as well as William S. Wojcik Ltd. in Oak Lawn.
