Pekin Insurance Co. sues Friedler Construction Co. over claims of work site carelessness

A Cook County-based insurance company is suing over claims that an employee of a represented plumbing company was injured on the job.

Pekin Insurance Co., as subrogee of Best Plumbing Inc. and Ken Mitera, filed a lawsuit Aug. 11 in Cook County Circuit Court against Friedler Construction Co., citing negligence.

According to the claim, Best Plumbing had been retained by Friedler Construction for work in a public school's boiler/mechanical room. Mitera, who is an employee of Best Plumbing Inc., was injured when he tripped and fell on a discarded piece of conduit left by a Friedler affiliate while coming off a ladder in the room on Aug. 21, 2014 – causing him personal injuries, including a tear to his meniscus.

Pekin Insurance is seeking damages for Best Plumbing and Mitera in the amount of $72,525.42 for Mitera’s medical expenses , plus the costs of this suit for Friedler Construction Co.’s negligence to not tend to electrical debris left on the floor in the boiler/mechanical room after it completed work in the same public school that day, the claim states.

They are being represented by Russell M. Barnett of Esp Kreuzer Cores in Wheaton.
