An Illinois man is suing a Chicago fitness center for allegedly allowing unsafe conditions that led to his injury in a fall.

Richard Rodriguez filed suit Aug. 19 in Cook County Circuit Court alleging that the defendant, Fitness International LLC, did not ensure safe conditions in the facility’s sauna during a July 25, 2014, visit.

According to the complaint, Rodriguez attempted to step into the defendant's sauna when his foot fell through the floor. Rodriguez claims Fitness International knowingly used improper materials to construct a walking surface in or around the sauna, allowed the walking surface to become and remain dangerous and unsafe, and neglected to inspect the sauna for safety.

The suit alleges Fitness International’s negligence caused Rodriguez, who was visiting the health club as a business invitee on that day, to sustain “personal, permanent and pecuniary” injuries as a result of falling in the sauna.

Attorney Christopher J. Goril of the Chicago firm Breen Goril Law is representing Rodriguez in the suit, which seeks damages of more than $50,000.

Cook County Circuit Court case number 2015L008499.
