A Cook County woman is suing a furniture store, alleging defective outdoor furniture.
Marie Delgavio filed a lawsuit Aug. 18 in Cook County Circuit Court against Restoration Hardware Inc., alleging the furniture she purchased began developing defects in its finish within a year of purchase.
According to the complaint, the items Delgavio purchased June 10, 2006, at the Lincoln Park store, were advertised as having a durable, low-maintenance finish. However, by the spring of 2007, the plaintiff reported extensive problems with chipping, peeling and finials falling off the furniture.
The suit says the problem persisted even after Restoration Hardware sent a technician to make repairs. In 2010, when Delgavio complained to customer service, they sent materials for her to make the repairs herself. By that time, the plaintiff said the damage was too extensive for her to repair.
Delgavio seeks a jury trial, a full refund of the purchase price of $97,264.65, plus attorney fees and other damages. He is represented by attorney William J. Hoffmann of Grotefeld, Hoffmann, Schleiter, Gordon, Ochoa and Evinger in Chicgo.
