Cook County woman suing Bloomingdale's for alleged malicious behavior

A Cook County woman is suing over claims of malicious behavior and eventual wrongful prosecution against Bloomingdale's department store.

Kathleen Murphy filed a lawsuit Aug. 21 in Cook County Circuit Court against Bloomingdale’s Inc., a division of Macy’s Retail Holdings Inc., citing negligence.

According to the claim, Bloomingdale’s and its employees practiced malicious behavior when dealing with Murphy – who was legally shopping at Bloomingdale’s at 900 N. Michigan Ave., Chicago – when they believed that Murphy was shoplifting from the store on Sept. 27, 2013. Employees of the store attacked her causing her to sustain personal injuries, including a broken arm, the claim states.

Murphy is seeking damages of more than $50,000, plus costs and is asking for any other further relief deemed reasonable and appropriate for Bloomingdale’s and its staff’s negligence in physically harming her, the claim states. She is being represented by Jeffrey S. Duetschman and Bradley A. Skafish of Deutschman and Associates, P.C. in Chicago.
