A Cook County man is suing over claims he was injured by an unnamed employee of Chicago Beverage LLC.

Lavell Malone filed a lawsuit Aug. 25 in the Cook County Circuit Court against John Doe, the unknown employee, and Chicago Beverage Systems LLC, citing negligence and battery.

According to the claim, Malone was traveling on his skateboard in the vicinity of 2264 N. Lincoln Ave., Chicago, near the defendant's truck, on May 15. Doe practiced careless judgment while in the passenger seat of the Chicago Beverage Truck when he exited the truck and proceeded to strike Malone in the face, fracturing his jaw in the process.

Malone is seeking damages of more than $50,000, plus the costs of this suit, and demands that the issues joined herein be tried by jury for Doe’s and Chicago Beverage Systems LLC’s negligence to not further practice safety and refrain from injuring Malone after a few words were exchanged, which has caused Malone to incur large sums of money for medical expenses, the claim states.

He is being represented by Gregory E. Kulis of Gregory E. Kulis and Associates, Ltd., and Sami Azhair of Azhair LLC, both located in Chicago.

Cook County Circuit Court case number 2015L008660.
