Man sues nursing home over alleged improper care of resident

A man is suing Lakeview Rehabilitation and Nursing Center LLC, citing negligence that led to a resident’s injuries.

Sean Gaurige, administrator of the estate of Rita DeNicolo, filed suit Aug. 17 in Cook County Circuit Court, Law Division, against Lakeview Rehabilitation and Nursing Center LLC. The charges, brought under the Nursing Home Care Act, concern a lack of proper care of DeNicolo's known medical conditions.

The lawsuit covers the period from Aug. 2, 2012, through Jan. 24, 2014, when DeNicolo lived at Lakeview. According to the lawsuit, DeNicolo suffered from diabetes, multiple sclerosis, incontinence, dementia, and other conditions requiring round-the-clock person care and assistance with daily living. The plaintiff claims that DeNicolo suffered from avoidable pressure sores, a blocked feeding tube, lacerations from a fall, inadequate nutrition, improper wound care and other alleged injuries that caused her pain, suffering, loss of normal life and medical costs.

Attorney Jeffrey Schlapp of the Chicago law firm of Schlapp Law Group LLC, is representing Gaurige in the lawsuit, which seeks all damages as allowed by law plus litigation costs.
