Family accuses University of Chicago Hospital of wrongful death

CHICAGO — A Cook County family is suing a Chicago hospital, alleging negligence in the death of a loved one.

Najah Zegar, as special administrator of the estate of Shakib Zegar, deceased, filed a lawsuit Oct. 22 in Cook County Circuit Court against University of Chicago Medical Center, also known as University of Chicago Hospitals and/or University of Chicago Medicine.

According to the complaint, the hospital acted negligently in the care of Shakib Zegar, which resulted in his death Oct. 22, 2013. The suit says Zegar was being provided post-surgical care after triple bypass surgery. He received an extracorporeal membrane oxygenation machine (EMCO) into his femoral artery, the suit says, and he had to be turned to deter bedsores. 

The staff turned him to his right side, which resulted in his EMCO dislodging and causing him to suffer massive bleeding, the lawsuit states, and the blood loss caused him to die.

The suit says the defendant failed to provide adequate procedures for moving and turning the patient following the insertion of the EMCO to prevent it from dislodging, and failed to observe the patient's vitals to note he was suffering massive bleeding.

The complaint alleges the plaintiff suffered grief, sorrow and pecuniary losses including but not exclusively, goods, services and loss of society.

Najah Zegar seeks more than $50,000, plus court costs. She is represented by attorney Kevin W. O'Connor of O'Connor Law Firm in Chicago.
