Kenosha businesses sue Enhanced Medical Revenue, seeking $354,000

Two Wisconsin businesses are suing a billing service, alleging unpaid medical bills.

Southeast Wisconsin Ambulatory Surgery Center and Wisconsin Neuropathy Center, both of Kenosha, Wis., filed a lawsuit Aug. 26 in Cook County Circuit Court against Enhanced Medical Revenue of Chicago.

According to the complaint, in May 2012, both parties entered into a billing services agreement whereby EMR was to bill all government, third-party and self-pay customers according to the plaintiffs’ rules. EMR also was responsible for follow-up and collections of delinquent accounts, the suit says, as well as for monthly reports to the plaintiffs.

The complaint states EMR breached the agreement by failing to issue bills in a timely manner, neglecting to send monthly reports and avoiding follow-up and collection of unpaid debts.

The plaintiffs seek a jury trial and damages in of more than $354,000, including pre- and post-judgment interest, attorney fees, costs and punitive damages. They are represented by attorneys Thomas G. Gardiner, Micah J. Hughes and Kyle P. Carlson of Gardiner Koch Weisberg & Wrona of Chicago.
