A Des Plaines woman is suing a scooter rental company, alleging the scooter she rented after having foot surgery malfunctioned, damaging her foot and requiring additional surgery.
Joann Spellman filed a lawsuit Aug. 21 in Cook County Circuit Court against Roll-A-Bout Corp. and Buffalo Grove Drug Company Inc. doing business as Mark Drug Medical Supply, alleging negligence.
According to the complaint, on Aug, 17, 2013, Spellman rented Roll-A-Bout’s knee scooter model RA-250 from Mark Drug. When she attempted to use it Sept. 3, 2013, the suit says, a bolt sheared off, causing her to fall off the scooter, injuring her head, wrist, elbow and knee.
The lawsuit states X-rays showed her fall fractured the screw that had been inserted in her foot Aug. 14, 2013. New surgery was subsequently ordered to repair her foot, the suit says.
Spellman seeks damages of more than $50,000. She is represented by attorneys Charles T. Newland and Sean D. Jordan of Charles T. Newland & Associates in Arlington Heights.
