Son accuses Gardens of Belvidere of negligence in father’s death

CHICAGO – A Cook County man is suing a Belvidere nursing home, alleging it failed to prevent his father from falling and suffering fatal wounds.

Jesus Hernandez, special administrator of the estate of Jose Hernandez, filed a lawsuit Dec. 17 in Cook County Circuit Court against The Gardens of Belvidere LLC, Park Place of Belvidere, Park Place of Belvidere LLC and AA Healthcare Management LLC, alleging medical malpractice.

According to the complaint, Jose Hernandez fell and injured himself several times during his residency at The Gardens of Belvidere. One of the falls caused Hernandez to develop a subdural hematoma (blood clot beneath the brain), the suit says, which caused his death March 4, 2014. 

The plaintiff blames The Gardens for failing to adequately supervise and monitor Jose Hernandez to prevent his fatal injuries.

Jesus Hernandez seeks a jury trial and damages of more than $50,000. He is represented by attorney Brian J. Holmes of Hurley McKenna & Mertz PC in Chicago.
