CHICAGO – An insurance company covering an Illinois property management firm is suing a tenant and general contractor, seeking to recover damages from a fire allegedly started by the defendants.
Bradley Place Property Owner II LLC and its subrogee, Central Mutual Insurance Co., filed a lawsuit Dec. 21 in Cook County Circuit Court against Howard S. Weingarten Builder LLC and IK Gymnastics LLC, alleging negligence and liability for property damage.
According to the complaint, IK Gymnastics hired Howard S. Weingarten Builder in 2014 to paint and stain walls within property it leased from Bradley Place in Chicago. The suit says the painting work caused a fire in the building’s dumpster Oct. 29, 2014, damaging the property.
Central Mutual seeks reimbursement for covering the fire damage claim for Bradley Place, including the policy’s $25,000 deductible.
The plaintiffs seek damages of more than $50,000, plus legal expenses. They are represented by attorneys Steven R. Johnson of Langhenry, Gillen, Lundquist & Johnson LLC in Chicago and James B. Hamilton of Groover Hamiliton LLP in Plano, Texas.
