Cook County man alleges Mount Sinai Hospital caused fiance's death

CHICAGO – A Cook County man is suing Chicago health care providers, alleging his fiance’s anesthesiologist placed her breathing tube into her throat by mistake, causing her death from oxygen deprivation.

Daniel C. Klein, special administrator and next friend of Julia Castellanos, filed a lawsuit Dec. 22 in Cook County Circuit Court against Sinai Health System, Mount Sinai Hospital, Mount Sinai Medical Group Ltd. and Dr. Domingo I. Osunero Jr., alleging negligence, medical malpractice and wrongful death.

According to the complaint, Osunero administered anesthesia to Castellanos during her Nov. 16 surgery at Mount Sinai Hospital. The suit says Osunero deviated from the standard of care by not checking Castellanos’ airway before and during the operation, and failed to detect an esophageal intubation in a timely manner. 

As a result of this negligence, the lawsuit states, Castellanos suffered an anoxic brain injury and died Nov. 19. Klein and Castellanos had two minor children together.

Klein seeks damages of more than $50,000, plus litigation costs. He is represented by attorneys Gary D. McCallister and Mary M. Williams of the McCallister Law Group LLC in Chicago.
