Daughter blames Lexington of Schaumburg for mother’s nursing home death

CHICAGO – A Cook County woman is suing a Schaumburg nursing home, alleging it failed to provide adequate supervision and care, resulting in her mother's death.

Laura A. Potts, independent administrator of the estate of Marilyn L. Potts, filed a lawsuit Dec. 21 in Cook County Circuit Court against Lexington of Schaumburg and Lexington Healthcare Center of Schaumburg Inc., alleging violations of the Illinois Nursing Home Care Act.

According to the complaint, Marilyn Potts suffered injuries while she lived at Lexington of Schaumburg as a result of the staff’s lack of supervision and assistance with mobility. The suit says Potts suffered a fall while using the restroom, causing wounds that led to her death June 28, 2014.

Laura Potts seeks a jury trial and damages of more than $50,000, plus court costs. She is represented by attorney Howard M. Zavell of Dickler, Kahn, Slowikowski & Zavell Ltd. in Arlington Heights.
