CHICAGO – A Cook County man alleges the owners of the property where he and a partner leased restaurant space owe him for five years of ongoing water damage to his business.
Bala Ghimire and Annapurna Inc. filed a lawsuit on Dec. 14 in Cook County Circuit Court against Burton S. Gilberg, individually and doing business as Gilberg Realty Management, 899 Plymouth Court LLC and The 899 South Plymouth Condominium Association, alleging a case of fraud and deceptive business practices.
According to the complaint, Annapurna leased a unit from the defendants in May 2008, with Ghimire as the lease guarantor. Beginning in 2009 and continuing through September 2014, the suit alleges the swimming pool in the unit above the Chicago Curry House periodically leaked, damaging inventory and equipment, and causing the business to be shuttered for weeks at a time. The allegation of fraud arises from the plaintiffs’ assertion that the defendants failed to disclose a latent flaw in the premises.
The plaintiffs seek damages of more than $500,000 for loss of business income, repairs, property damage and lost inventory. They are represented by attorney Marvin Brustin of Brustin & Landblad Ltd. and Edward R. Moor of the Moor Law Office P.C., all of Chicago.
