Client accuses two law firms of malpractice in personal injury case

CHICAGO – A Cook County man is suing two law firms, alleging they made mistakes in handling his personal injury case.

Michael Foglia filed a lawsuit Dec. 18 in Cook County Circuit Court against the Motlzen Law Group Ltd. in Hinsdale, Edward W. Moltzen, the Law Offices of Richard W. Hakanson in Oak Brook, and Richard W. Hakanson, alleging legal malpractice.

According to the complaint, on Aug. 6, 2010, Foglia was injured while being towed in an inner tube behind a boat on Lake Columbia in Michigan. The suit says Foglia retained Hakanson and his firm to represent him in processing a bodily injury claim against those responsible for his injuries. Hakanson forwarded Foglia’s case to Moltzen and his firm.

The suit says neither firm filed Foglia’s case within the statute of limitations in Michigan, nor did they issue the summons required by the U.S. District Court for the Western Division of Michigan. The plaintiff alleges the defendants told him the insurance company in the personal injury case was willing to settle out of court through mediation but, in actuality, the Michigan court had dismissed Foglia’s case.

Foglia seeks a jury trial and damages of more than $50,000, plus litigation costs. He is represented by attorney Bart J. Galvin of Winters Salzetta O’Brien & Richardson LLC in Chicago.
