Hip pain patient accuses Zimmer U.S. of faulty prosthetic design

CHICAGO – A Shelby County man is suing a medical device manufacturer , alleging a faulty design in the unit with which he was implanted.

Gary L. Smith filed a lawsuit Dec. 23 in Cook County Circuit Court against Zimmer U.S. Inc., Zimmer Inc., Zimmer Holdings Inc., Zimmer Surgical Inc., Zimmer Daniel and Zimmer Daniel & Associates, alleging product liability.

According to the complaint, shortly after Smith received a Zimmer Durom hip system on Jan. 10, 2007, doctors told him the unit had failed and he needed to be fitted with a different prosthetic hip joint. During the replacement surgery, Smith’s surgeon reported extensive soft tissue damage in Smith’s hip, the suit says. 

The plaintiff blames the Durom’s novel design, which was later recalled by the FDA, for the damage.

Smith seeks a jury trial and damages of more than $50,000, plus legal costs. He is represented by attorney Peter J. Flowers of Meyers & Flowers LLC in Chicgao.
