97-year-old man's injuries trigger lawsuit against Atrium Health

CHICAGO – The daughter of a 97-year-old man is suing a nursing care facility claiming its negligence caused injuries to her now-deceased father.

Erica Scott, independent administrator for the estate of Isaac Foster, filed a lawsuit Jan. 13 in Cook County Circuit Court against The Atrium Health Care Center Ltd., doing business as The Atrium Health Care Center, alleging liability for personal injury.

Foster lived at The Atrium from July 5, 2012 to Dec. 28, 2014, with intermittent hospitalizations. The complaint alleges The Atrium and its staff committed numerous violations of Illinois’ nursing home statutes, including neglect of Foster leading to skin breakdown and pressure ulcers, multiple falls resulting in a head injury, and other wounds. The suit claims The Atrium was statutorily responsible for designing a treatment plan to avoid such injuries.

Scott seeks damages in excess of $50,000. She is represented by attorney Bella Feinstein of the Law Offices of Steven J. Malman & Associates P.C. in Chicago.
