CHICAGO – A Cook County man working for a recycling firm says he was injured after Grecian Delight allegedly failed to repair a hazardous stairway, despite his previous warnings about a defective step.
Tracey Burns filed a lawsuit Jan. 13 in Cook County Circuit Court against Grecian Delight Foods Distribution LLC, Grecian Delight Foods Inc. and Grecian Delight Venture LLC, alleging negligence and premises liability.
Burns, an employee of United Liquid Waste Recycling Inc., was working at the defendants’ Elk Grove Village property on March 12, 2014, when, according to the complaint, he suffered injuries from a fall on a broken metal step. A week earlier, the suit says, Burns had notified Grecian Delight about the defective step, but it had not been repaired at the time of the incident. In addition, the plaintiff says the step appeared to be in good working order before he used it, and no warning signs stating otherwise had been posted.
Burns seeks compensation for pain and suffering, medical expenses and legal costs in excess of $50,000. He is represented by attorney Stephen J. Smalling of Capron & Avgerinos P.C. in Chicago.
