CHICAGO – A Cook County man is suing a Jacksonville nursing home, alleging its negligence led to his broken hip.
Jim McFedries filed a lawsuit Jan. 20 in Cook County Circuit Court against North Church Nursing & Rehab, doing business as Aperion Care Jacksonville, David Berkowitz, Yosef Meystel, Yam Management LLC, Yam Consulting LLC, Aperion Consulting LLC, Aperion Care Inc., Susan Arachikavitz, Katie Wiswell, Michael Bova, individually and as medical director, and Michael Bova M.D. S.C, a corporation; alleging medical negligence and other violations of the Illinois Nursing Home Care Act.
According to the complaint, McFedries, a diabetic resident of Aperion, suffered from drop foot, a condition preventing him from lifting the front part of the foot. The suit says on Feb. 24, 2014, McFedries was not provided with a temporary brace, wheelchair or walker to assist with his walking, causing him to fall and suffer a fractured hip.
The lawsuit states Aperion was understaffed and the existing staff had been inadequately trained to provide the plaintiff’s care.
McFedries seeks damages of more than $50,000. He is represented by attorney Charles E. Webster of Brustin & Lunblad Ltd. in Chicago.
