Daughter accuses Weiss Memorial of negligence in father’s injuries

CHICAGO — A Cook County woman is suing Weiss Memorial Hospital and three doctors, claiming their negligence injured her deceased father.

Susan McLain, independent executor of the estate of Roger McLain, filed a lawsuit Jan. 22 in Cook County Circuit Court against VHS Acquisition Subsidiary Number 3 Inc., doing business as Weiss Memorial Hospital and Weiss Memorial Hospital Foundation, and Dr. Robert Brinkman, Dr. Jennifer Dwyer and Dr. Malik Khalid, alleging medical malpractice.

According to the complaint, when Roger McLain was hospitalized in November 2013 and January 2014 for respiratory distress at Weiss Memorial Hospital, he developed pressure ulcers that became infected, causing sepsis syndrome. The suit claims the defendants failed to monitor Roger McLain’s skin condition, use air mattresses to prevent ulcer formation, or keep the skin clean and dry. Roger McLain died on July 9, 2015.

McLain seeks damages in excess of $50,000. She is represented by attorney Timothy P. Rhatigan of the Rhatigan Law Offices LLC in Chicago.
