Man sues debt collection firm over alleged harassing calls

CHICAGO — An Illinois man is suing a consumer debt collector for allegedly making repeated, harassing calls to his cellphone for no reason.

Lee Momient filed a lawsuit Jan. 27 in Cook County Circuit Court against EOS CCA, alleging invasion of privacy and violations of the Telephone Consumer Protection Act.

According to the complaint, EOS made at least 50 calls to the plaintiff’s cellphone between July of 2011 and January of 2016. Each call was allegedly initiated by an autodialer, and sometimes would hang up or play a recorded message of information about EOS. On other calls, Momient says an agent would speak, but ask for someone else. The plaintiff claims these unauthorized calls were not only a nuisance, but were attempts to intimidate or harass him into paying a debt he did not owe.

Momient seeks a jury trial and damages in excess of $100,000, including treble damages of $1,500 for each alleged call violation, punitive damages and litigation costs. He is representing himself.
