Nursing home faces negligence claim in death

CHICAGO – A Cook County man says staff members at a nursing home neglected his father’s care, causing him to have a stroke and other complications that led to his death.

Leonard Thomas Jr., independent administrator of the estate of Leonard Thomas Sr., filed a lawsuit in Cook County Circuit Court against Windmill Nursing Pavilion Ltd., alleging negligence under the Illinois Nursing Home Care Act. The Ingalls Memorial Hospital was named as a respondent in discovery.

According to the complaint, Leonard Thomas Sr. was a Windmill resident who suffered from dementia, as well as a noted risk of developing dehydration and malnutrition. The suit says Windmill staff neglected Thomas’ care, causing him to develop dehydration, renal failure, malnutrition, seizures and a stroke caused by dehydration on March 21, 2014. As a result of his injuries, the claim states, he required medical and surgical care, incurred medical expenses, and became disabled and unable to manage his estate. The suit says Thomas’ injuries contributed to his death a few weeks later, on April 8, 2014.

Leonard Thomas Jr. seeks damages in excess of $50,000, plus litigation costs. He is represented by attorney David G. Pribyl of Dudley & Lake LLC in Libertyville.
