CHICAGO – An air carrier is being sued by one of its passengers after he was allegedly injured on a flight.
Volodymyr Didenko filed a lawsuit on Jan. 28 in Cook County Circuit Court against Spirit Airlines Inc., citing negligence and common carrier negligence.
According to the claim, Didenko boarded Flight NK736 heading from Los Angeles to Chicago on Nov. 15, 2015. Through its employees, Spirit allegedly should have known that the trays attached to the seats on Flight NK736 were not level and were tilted toward the person seated in front of the tray. This caused objects to slide in the direction of the person seated, the suit states.
During the flight, the suit states that flight attendants provided a drink service, which included hot beverages. While Didenko was getting money to pay for the beverage, the flight attendant placed the open container of hot liquid on the tray and the container slid toward him, spilling on him, the suit claims. He allegedly suffered personal injuries due to the spill.
Didenko is seeking the court to enter judgment in his favor for an amount in excess of the minimum jurisdictional limits. He is represented by Gerald J. Bekkerman of Bekkerman Law Offices LLC in Chicago.
