Patron accuses Small Bar of overserving alleged assailant

CHICAGO — A Cook County man says a fellow patron at Small Bar on North Albany Avenue got drunk and assaulted him after allegedly being served too much liquor.

Julio Ontanon filed a lawsuit in Cook County Circuit Court against Rambutan LLC, also known as Small Bar or Pub Royale, and Ian McCarthy, alleging assault, battery and dram shop liability.

According to the complaint, Ontanon and McCarthy were both patrons at Small Bar on Feb. 1, 2015 when McCarthy became intoxicated and violent, striking Ontanon. The suit says McCarthy had consumed several alcoholic beverages served at the bar.

Ontanon seeks damages in excess of $50,000. He is represented by attorney Michael C. Goode of Chicago.
