CHICAGO — A Cook County woman is suing Berkeley Nursing and Rehab Center and two other entities over injuries her 73-year-old mother allegedly suffered while she resided at the facility, which the suit says contributed to her death.
Hazel Butler, independent administrator of the estate of Elizabeth Ross, filed a lawsuit Feb. 1 in Cook County Circuit Court against Berkeley Nursing and Rehabilitation Center LLC (doing business as Berkeley Nursing and Rehabilitation Center), J.B. Healthcare LLC and Senior Healthcare Management LLC, alleging personal injury liability under the Illinois Nursing Home Care Act.
Named as respondents in discovery are Dr. Ndudi Aniemeka, Rush Oak Park Hospital Inc. (doing business as Rush Oak Park) and Boycin Medical Clinic Ltd.
According to the complaint, after suffering a right leg fracture, Ross was a resident of Berkeley for approximately one month in early 2014, with intermittent hospitalizations. On Feb. 27, 2014, the suit says, attendants found Ross in bed with blood on her hands, arms and legs. She was later diagnosed with a rectal hemorrhage, low blood pressure, anemia, dehydration, irregular heartbeat and low blood volume. Butler claims the defendants’ neglect allowed these conditions to occur.
The plaintiff seeks damages and is represented by attorneys Susan L. Novosad and W. Kent Winingham of Levin & Perconti in Chicago.
