Landlord's insurer files liability suit over fire

CHICAGO — The insurance company for Edgewater Place Condominiums is suing an Illinois man, alleging that a fire started in a unit he leased to another tenant.

Leading Insurance Services Inc., on behalf of Edgewater Place Condominiums, filed a lawsuit Feb. 3 in Cook County Circuit Court against Greenbluff LLC and Kevin Razko, doing business as Greenbluff LLC, alleging property damage liability.

According to the complaint, Razko, who operates Greenbluff to buy and lease condominium units, owned unit 2C in Edgewater, which he leased to Tracy Koppenhoefer on Feb. 7, 2014. On that same day, the suit claims, a fire broke out in the complex, which firefighters determined started from carelessly disposed of smoking materials in the bedroom of unit 2C.

Although the Edgewater bylaws state that individual residents are liable for any damages they cause to common areas, neither Razko nor Greenbluff have made any payments for the fire damage, the suit alleges. LIS paid Edgewater $91,635.42 (less a $1,000 deductible) to settle the damage claim, according to the suit.

LIS seeks a jury trial and recovery of $92,635.42 for both damages and the deductible amount. It is represented by attorney P. Joel Radakovich of Grotefeld Hoffman LLP in Chicago.
