Restaurant blamed for mother's alleged drunk driving

CHICAGO – Representatives of an infant are going to court against a restaurant for damages, claiming that the business is responsible for the baby's mother’s motor vehicle accident.

Tyler Heyward, a parent and next friend of a minor, filed a lawsuit on Feb. 1 in Cook County Circuit Court against Ruth Chris Steakhouse of South Barrington, citing the Illinois Dram Shop Act.

The minor, born on May 26, 2015, is the son of Tyler Heyward and Amber Honaker. The plaintiffs assert that on Dec. 4, 2015, Honaker attended a Christmas party at defendant’s place of business, where she drank "copious amounts " of alcohol. At approximately 8 p.m., Honaker then left and drove on the wrong side of the road, and collided head-on with another vehicle.

The complaint states that as a result of the collision, Honaker allegedly suffered severe and permanent bodily injuries which will require surgery, intensive physical therapy, and recuperation. She was also allegedly incarcerated and is facing possible charges of driving under the influence, which may include sentencing if found guilty. The plaintiffs assert that  Honaker was the sole support of her sond, and, due to the lack of discretion by the restaurant, the child has now allegedly lost his main source of support.

The plaintiffs seek damages of more than $100,000, and the costs related to the suit. Plaintiffs are represented by attorney Donald S. Nathan, of Arlington Heights.
