Lung patient claims negligence in surgery case

CHICAGO — A Cook County man says alleged negligence on the part of the independent contractors hired to perform his lung surgery caused him to suffer severe injuries.

Michael Patti filed a lawsuit Feb. 8 in Cook County Circuit Court against Presence Chicago Hospitals Network (doing business as Presence Resurrection Medical Center), Presence Health Partners LLC, Cardiac Surgery Associates S.C., Dr. Jeffrey M. Silver and physician assistant–certified Matt Martin, alleging medical negligence.

According to the complaint, Patti came to the emergency room at Resurrection on Dec. 31, 2013, with shortness of breath, back pain and flu-like symptoms, and was admitted to the hospital. The suit says that on Feb. 6, 2014, Patti underwent a right total lung decortication, or surgical removal of the membrane covering the lung, performed by Silver and Martin.

As a result of the surgery, Patti claims he was injured internally and externally, suffered acute and prolonged physical and mental pain, and incurred large expenses for medical care and treatment. The suit also says Silver and Martin did not work for Resurrection or any of the other defendants, but were independent contractors.

Patti seeks damages in excess of $50,000 for medical, drug and incidental expense and general damages to be proven at trial. He is represented by attorney James A. Karamanis and Jennifer Timm of Barney & Karamanis LLP in Chicago.
