Patient sues over alleged negligence in dental work

CHICAGO — A Cook County man is suing over dental work that he claims resulted in pain and injury.

John Agee is suing Dr. Anna Pelak, D.D.S.; Total Dentistry Inc.; Dr. Mark Palo, D.D.S.; and Oakbrook Endodontic Associates Ltd., citing alleged negligence that resulted in pain and injury.

Agee sued on Feb. 5, in Cook County Circuit Court, alleging that the defendants knowingly failed to properly communicate the referral for treatment and failed to review all dental records prior to treatment.

According to the complaint, the plaintiff alleges that, on Feb. 12, 2014, he was suffering pain and saw Pelak, who said he needed a root canal on tooth number 12. However, the suit alleges, Pelak made an incorrect notation on her referral to Palo, marking tooth number 13 as the one that needed a root canal, which was then performed by Palo.

Agee returned to Pelak and Palo for further work and received the root canal on the correct tooth, the suit says, but the plaintiff holds the defendants responsible for pain and injury for allegedly referring the wrong tooth for treatment and failing to review all dental records.

The plaintiff seeks the following: compensation for an amount exceeding the minimum jurisdictional limits of the court and costs. He is represented by John B. Schwartz of John B. Schwartz and Associates in Chicago in Illinois.
