Cancer patient sues over alleged failure to inform

CHICAGO — A Cook County woman is suing a doctor, a health-care services company and a hospital over allegations that a chest X-ray showed a mass in her lung that she did not learn about for nearly 10 months.

Mary M. Gervasio is suing Dr. Joseph E. Cortez, EM Strategies Ltd. and Silver Cross Hospital and Medical Centers, citing alleged negligence that resulting in an injury.

Gervasio filed a complaint on Feb. 11 in Cook County Circuit Court, alleging that the defendants knowingly failed to diagnose and inform her about her medical test.

According to the complaint, the plaintiff alleges that, on April 19, 2013, an X-ray revealed a mass in her lung, but she first became aware of the abnormal results on Feb. 13, 2014. The complaint says the mass grew during that time, and was diagnosed as lung cancer that eventually metastasized to other parts of her body, including her spine.

Gervasio's suit holds the defendants responsible because they allegedly failed to inform her about the abnormal findings of the X-ray and made no recommendation to seek a medical specialist.

The plaintiff seeks the following: compensation for an amount in excess of $50,000 plus costs of suit. She is represented by Adam C. Kruse of Walsh, Knippen, Pollock & Cetina, Chartered in Chicago.
