Melrose Park Auto Mall accused of breach of contract

CHICAGO – A Lombard man alleges that a dealership wrongfully repossessed the car he bought.

Joseph Farmer filed a complaint on Feb. 24 in Cook County Circuit Court against Melrose Park Auto Mall Inc. and James R. Marte Jr., citing breach of contract and consumer fraud.

According to the complaint, the plaintiff alleges he purchased a car on Nov. 7, 2015, and paid $1,200 as down payment for it. The suit states the car was later repossessed because the defendant stated it was unable to sell the contract to a third party, which the plaintiff says was not a condition of the contract. The plaintiff holds the defendants responsible because they allegedly breached their contract with plaintiff and refused to return the down payment for the car, plus personal belongings left in the vehicle.

The plaintiff seeks the following: compensation for compensatory and punitive damages, attorney's fees and costs. He is represented by Daniel A. Edelman, Cathleen M. Combs, James O. Latturner and Sarah M. Barnes of Edelman, Combs, Latturner & Goodwin LLC in Chicago.
