CHICAGO — A truck driver who worked in waste hauling is suing an energy firm, claiming lime waste overflowed his truck and landed on him, causing severe and permanent injuries.
Timothy Cooper is suing Arcelormittal USA LLC, BH Coke Energy Company doing business as Coke Energy, Suncoke Energy Inc, and Primary Energy Operations LLC, citing alleged negligence that resulted in injuries.
The plaintiff sued on Feb. 19 in Cook County Circuit Court, holding the defendants responsible for not warning of an air pocket in a silo of lime waste.
The plaintiff alleges that, on March 1, 2014, he was loading a truck with lime waste from the silo when the air pocket collapsed, causing the lime waste to overflow his truck and land on the plaintiff, with lime waste landing on his eyes and causing severe injuries. He holds the defendants responsible for not warning that the air pocket was in the lime waste.
The plaintiff seeks the following: compensation in excess of $50,000. He is represented by Daniel Spector of Goldberg Weisman Cairo in Chicago.
