Administrator alleges New Lenox care facility was negligent in preventing falls

CHICAGO – An estate administrator filed suit against a New Lenox facility alleging that it knowingly violated the Assisted Living and Shared Housing Establishment Code by failing to exercise reasonable care.

Georgia Ryba, independent administrator of the estate of Rose Prass, filed a complaint on Jan. 19 in Cook County Circuit Court against Encore Senior Living LLC and Lemont Nursing and Rehabilitation Center, citing negligence.

According to the complaint, the plaintiff alleges that on Feb. 16, 2014, her decedent suffered multiple falls resulting in injuries, which included a fracture in the right femur. The plaintiff holds Encore Senior Living LLC and Lemont Nursing and Rehabilitation Center responsible because the defendants allegedly failed to provide appropriate assistance and supervision in order to prevent her decedent from falling.

The plaintiff seeks tcompensation for an amount in excess of $50,000 plus the costs of suit. She is represented by Robert J. Rooth of The Rooth Law Firm in Chicago.
