Estate seeks relative's records from long-term nursing facility

CHICAGO — An estate is suing an Oak Lawn long-term nursing facility, alleging failure to respond to a request for medical records.

Eva Matwiej, authorized relative for Halina Matwiej, filed a complaint March 28 in Cook County Circuit Court against the Oak Lawn Respiratory And Rehabilitation Center LLC, doing business as Oak Lawn Respiratory and Rehab, alleging failure to comply with her request for documents.

According to the complaint, on Jan. 19, Eva Matwiej requested a copies of Halina Matwiej's medical records. She died Dec. 22, 2015. The plaintiff alleges the defendant failed to provide her request for a medical records.

Eva Matwiej requests a trial by jury and damages in excess of court's jurisdictional limits, plus attorney fees. She is represented by attorney Kelly A. Sabo of the Law Offices of Steven J. Malman in Chicago.
