CHICAGO — An estate administrator is suing an Orland Park health center, alleging negligence.
Frank O'Brien of Tinley Park, as administrator for the estate of Joann O'Brien, filed a lawsuit April 4, in Cook County Circuit Court against Lexington Health Care Center of Orland Park Inc. alleging it knowingly violated the Illinois Nursing Home Care Act by failing to provide adequate assistance and supervision in giving medical care.
According to the complaint, on April 5, 2014, Joann O'Brien fell at the Lexington Health Care Center, resulting in a fracture to her hip. The suit says she endured pain and suffering, and had to have surgery to repair her broken hip.
The plaintiff alleges the defendant failed to adequately assess O'Brien's condition and failed to properly monitor her to prevent her from falling.
Frank O'Brien seeks a trial by jury, more than $50,000, plus attorney fees and the costs of suit. He is represented by attorney Gregory J. Lamorena of Karlin, Fleisher & Falkenberg LLC in Chicago.
