CHICAGO — A temporary guardian is suing a Des Plaines medical facility, alleging negligence led to injury.
Bret Foster, temporary guardian of Mildred Foster, a disabled person, filed a lawsuit April 1 in Cook County Circuit Court, against Ballard Respiratory And Rehabilitation Center, LLC, Ballard Respiratory And Rehab, Presence Ballard Nursing Center, Presence Senior Services-Chicagoland, Ballard Healthcare, Ballard Rehabilitation, Ballard Nursing Center, Ballard Nurisng Center Inc., Ballard RN Center, Inc., Presence Senior Services, Presence Ballard Rehabilitation and Presence RHC Senior Services of Des Plaines, alleging negligence in failing to provide adequate assistance and supervision.
According to the complaint, between July 5, 2013, and April 4, 2014, Mildred Foster suffered a left displaced fracture of the neck of her humerus and she developed Stage IV pressure ulcers. The plaintiff alleges the defendants failed to properly assess Foster's condition or provide adequate supervision for continuous care and treatment to prevent Foster suffering fractures and developing pressure ulcers.
Bret Foster seeks a trial by jury and more than $50,000, plus the costs of suit. He is represented by attorneys Brian J. Homes and Michael T. Mertz of Hurley McKenna & Mertz PC in Chicago.
