CHICAGO – A woman alleges that three health care facilities failed to treat her decedent's ulcers and pneumonia, which purportedly caused his death.
Brenda Gilmore, as special administrator for the estate of Mose Leaks, filed a complaint on April 5 in Cook County Circuit Court against
International Nursing & Rehab Center, International Nursing & Rehab Center LLC and Aperion Care International,
alleging that they knowingly violated the Illinois Wrongful Death Act by failing to provide treatment and services to promote healing and prevent infection.
According to the complaint, the plaintiff alleges that during and subsequent to April 28, 2014, Mose Leaks developed severe and infected decubitis ulcers and also developed pneumonia, which caused his death on June 6, 2014. The plaintiff holds the defendants responsible because they allegedly failed to assess her decedent's condition and notify a physician in a timely manner, and failed to treat the decubitis ulcers to prevent them from becoming infected.
The plaintiff requests a trial by jury and seeks an amount of more than $50,000. She is represented by Michael T. Mertz and Molly L. Condon of Hurley McKenna & Mertz PC in Chicago.
